ALTA/ACSM Land Title Surveys

Often in today’s complex commercial real estate market an ALTA/ACSM Land Title Survey is required prior to the completion of the real estate transaction. These surveys are prepared by a licensed land surveyor. An ALTA survey is similar to a boundary survey, but is prepared in compliance with a comprehensive set of standards that have been jointly prepared and adopted by the National Society of Professional Surveyors and the American Land Title Association. The ALTA survey requirements allow for consistent survey standards for the surveyor’s across the United States.

ALTA survey standards are a nationwide uniform set of standards developed by a joint effort of the American Land Title Association and the American Congress on Surveying and Mapping. The ALTA survey is specifically designed to satisfy the needs of lenders, corporations, and title companies when dealing with valuable commercial properties. An ALTA survey is a boundary survey that has been jointly prepared and adopted by the ALTA/ACSM.

Furthermore, an ALTA survey shows progress, easements, rights-of-way, and other factors influencing the ownership of land. An ALTA Survey is often prepared for commercial properties, as it will provide the title company with the information needed to insure the title to the land and about improvements to the high degree that a commercial development may require.

An ALTA/ACSM land title survey is used as part of the insurance and/or title certificate application, where property boundaries are required to be accurately documented and reported upon. Sometimes referred to as a “Due Diligence survey,” an ALTA / ACSM land survey is often commissioned to provide information from county zoning laws, set back requirements, and height requirements of a property.

ALTA surveys will depict boundaries, site improvements, easements, rights-of-way and other elements impacting the ownership of land. They are intended to inform the buyer, seller, lender, title company and/or attorney of possible encroachments or problems with the physical improvements or legal description both on, and adjacent to the property.

ALTA Surveys are generally required by mortgage lenders, to accompany a title insurance policy, when financing commercial and industrial properties. They may also be required when financing land for development or re-development.
